Empowering Your Child's Voice in Family Law - Views of the Child Report

Hello! As a professional dedicated to the Views of the Child Report, I understand the crucial role your child's voice plays in family law matters, especially during separation or custody disputes. Guided by the Family Law Act, my aim is to ensure your child’s views are considered appropriately in legal proceedings.

Understanding the Views of the Child Report:

According to the Family Law Act, it's essential to consider a child’s views when determining their best interests, unless it's inappropriate to do so. A Views of the Child Report, different from a Hear the Child Report, provides a comprehensive evaluation that includes your child’s perspectives, along with additional insights gathered from parents and sometimes others involved in the child's life.

How is the Report Authorized and Prepared?

  • The report can be initiated by an agreement between guardians, a consent order, or a judicial court order. Regardless of how it's authorized, I require a signed retainer agreement from both parents.

  • This report is evaluative, meaning it goes beyond just capturing the child’s views. I also gather information from parents and possibly other key individuals to complete a thorough evaluation and assessment.

  • It’s important to note that in this evaluative report, the child does not control what is included, and there is no confidentiality between the parents regarding the contents of the report.

The Process:

Initial Meeting:

I start by meeting your child in a comfortable setting, ensuring they feel at ease to express their true feelings and thoughts.

Gathering Insights:

Along with understanding your child's perspective, I also engage with parents and potentially other relevant individuals to form a comprehensive evaluation.

Report Compilation:

The Views of the Child Report will articulate the child's views, along with my professional assessment, to assist in legal decisions affecting the child.

Why Choose a Views of the Child Report?

  • This report provides crucial insights for making informed decisions in the child's best interests.

  • It ensures that your child’s voice is not just heard but also evaluated in the context of the overall family dynamics.

  • As mandated by the Family Law Act, this report aligns with legal requirements to consider the child’s views in family law matters.
